ALL SUBSCRIPTION FEES FOR diAry ELITE ARE NON-REFUNDABLE EXCEPT AS EXPRESSLY PROVIDED IN THIS REFUND POLICY. BY PURCHASING A SUBSCRIPTION, YOU ACKNOWLEDGE AND AGREE TO THIS NO-REFUND POLICY.
1. General No-Refund Policy
GMX Quantum LLC ("Company," "We," "Us," or "Our") DOES NOT ISSUE REFUNDS FOR diAry ELITE SUBSCRIPTIONS UNDER ANY OF THE FOLLOWING CIRCUMSTANCES:
- Change of mind or buyer's remorse after purchase;
- Failure to use the Service or activate subscription features;
- Dissatisfaction with features, functionality, or user interface;
- Technical difficulties on the user's device or network;
- User error, misunderstanding of features, or failure to read Terms of Service;
- Discovery that a free trial or free tier version is available;
- Forgetfulness or failure to cancel before automatic renewal;
- Financial hardship, inability to afford subscription, or unauthorized purchases by family members;
- Deletion of account or cessation of Service use before subscription period ends;
- Service interruptions, bugs, errors, or maintenance that do not meet the threshold specified in Section 2.
2. Exceptional Refund Circumstances
Refunds MAY be issued, at Our sole and absolute discretion, ONLY in the following limited circumstance:
2.1 Total Service Failure
A refund may be considered if ALL of the following conditions are met:
- The Service experiences a complete and sustained failure preventing ALL users from accessing ANY core features;
- The failure is caused exclusively by the Company's servers, infrastructure, or software (not user device, network, or third-party issues);
- The failure persists for a continuous period of seventy-two (72) hours or more;
- The user submits a written refund request to [email protected] within fourteen (14) days of the failure;
- The Company confirms, in its sole discretion, that the conditions above have been met.
Refunds under this section are:
- Limited to a pro-rated amount corresponding to the period of total Service failure;
- Issued in the original payment method used for the subscription;
- Processed within thirty (30) business days of approval;
- Subject to verification and investigation by the Company.
3. Platform-Specific Refund Policies
3.1 Apple App Store Subscriptions
Subscriptions purchased through the Apple App Store are subject to Apple's refund policies, not the Company's. To request a refund for an App Store purchase:
The Company has NO control over Apple's refund decisions and CANNOT guarantee that Apple will issue a refund.
3.2 Google Play Store Subscriptions
Subscriptions purchased through Google Play Store are subject to Google's refund policies. To request a refund for a Google Play purchase:
The Company has NO control over Google's refund decisions and CANNOT guarantee that Google will issue a refund.
4. Free Trial Terms
If the Company offers a free trial period for diAry Elite:
- You must cancel the trial BEFORE the trial period ends to avoid being charged;
- Cancellation instructions are provided in the App under Settings → Subscription;
- IF YOU FORGET TO CANCEL AND ARE CHARGED, THE NO-REFUND POLICY APPLIES. FORGETFULNESS IS NOT GROUNDS FOR A REFUND.
5. Subscription Cancellation
5.1 How to Cancel
You may cancel Your diAry Elite subscription at any time through:
- Apple App Store: Settings → [Your Name] → Subscriptions → diAry Elite → Cancel Subscription;
- Google Play Store: Google Play Store app → Menu → Subscriptions → diAry Elite → Cancel Subscription;
- In-App: diAry → Settings → Subscription → Manage Subscription → Cancel.
5.2 Effect of Cancellation
- Cancellation stops future billing but does NOT entitle You to a refund for the current billing period;
- You retain access to diAry Elite features until the end of the current billing period;
- After the billing period ends, Your account reverts to the free tier (diAry) with limited features;
- Cloud-synced journal entries remain accessible but will not sync new entries after downgrade.
6. Pricing Changes and Advance Notice
The Company reserves the right to modify subscription pricing at any time. Pricing changes will:
- Be communicated via email and in-app notification at least thirty (30) days in advance;
- NOT affect Your current subscription until the next renewal after the notice period;
- Provide You the opportunity to cancel before the price increase takes effect.
IF YOU DO NOT CANCEL BEFORE THE PRICE INCREASE, YOU AGREE TO PAY THE NEW PRICE. PRICE INCREASES ARE NOT GROUNDS FOR REFUNDS.
7. Chargebacks and Fraudulent Refund Requests
7.1 Chargeback Prohibition
YOU AGREE NOT TO INITIATE A CHARGEBACK OR PAYMENT DISPUTE WITH YOUR CREDIT CARD COMPANY, BANK, OR PAYMENT PROCESSOR WITHOUT FIRST CONTACTING THE COMPANY TO RESOLVE THE ISSUE.
7.2 Consequences of Chargebacks
If You initiate a chargeback or payment dispute without prior contact with the Company:
- Your Account may be immediately suspended or terminated;
- You may be permanently banned from using the Service;
- The Company may pursue legal action to recover the disputed amount, plus administrative fees and legal costs;
- The Company reserves the right to report fraudulent chargebacks to relevant authorities.
8. Refund Request Process
If You believe You qualify for a refund under Section 2 (Total Service Failure), You must:
- Email [email protected] with subject line "REFUND REQUEST – diAry Elite";
- Include: Your full name, email address associated with Your Account, subscription purchase date and amount, detailed description of the Service failure (dates, times, screenshots if applicable), and explanation of why You believe You qualify under Section 2.
Refund requests will be reviewed within thirty (30) business days. The Company's decision is final and non-appealable.
9. Dispute Resolution and Arbitration
Any disputes arising from this Refund Policy are subject to the Mandatory Arbitration and Class Action Waiver provisions in the diAry Terms of Service.
